Odex Survey
Update: Apparently the response was overwhelming and they have already collected enough results. The survey is over! Yay! Thanks for you help.
Apparently a group of Secondary 3 students are doing a school project on the whole Odex Incident. I’m not exactly sure what kind of school project starts at this time of the year, but whatever. Anyway, they politely requested for my help in publicizing the survey, so here I am. What a nice guy. So yeah, go do the survey!
P.S. And in a related news, PacNet successfully defended in court the identities of its users. Local forum discussions go nuts. Odex is expected to appeal. Refer to Straits Times.
Dear anime blogger,
I am Tan Yan Sheng, a secondary three student of River Valley High School. My group members and I are currently working on a school project regarding the recent incident of Odex’s crackdown on fansubs. One of the requirements of the project is for us to suggest a feasible and possible win-win solution for two parties to solve a common problem they faced. The topic that we are working on is the conflict between the anime fans and Odex.
From what we knew, many anime fans have been downloading “free” anime from the fansubs, and their acts have enraged Odex, the licensed anime retailer in Singapore, claiming that they are losing much of their profits due to the “irresponsible” acts of the anime fans. Rising tensions between the two parties have caused Odex to take legal action against the anime fans who downloaded anime “illegally”.
As third party observers, we are curious to know why the anime fans chose to take the risk of downloading anime from “unauthorized” sites like fansubs, instead of purchasing Odex’s licensed products. We would also like to know the views of the anime fans for their conflict with Odex. This is because we feel that these sources of information will serve significant purposes that help us to derive at a solution that can satisfy the needs of the two parties.
Therefore, we prepared a survey to help us to obtain our objectives. Knowing that you are one of the well-known anime bloggers in Singapore, having over hundreds of people reading it everyday, we would like to seek for your help to publicize our survey to the anime fans through your blog. We find that this is an excellent method to help us conduct our survey, as we would be able to get enough people to take part in the survey. This will really help us a lot to complete our task.

Hope their big stick doesn’t snap in the next 14 days when Odex decides to be a prick again.
If Pacnet survives the next 14 days though, the shit will hit the fan for Singnet and Starhub, and the Apocalypse of countersuits is gonna hit Singapore.

I use Starhub and am not going to jump to Pacnet. I don’t have a clue how Starhub and Singnet went about fighting their court cases, for all I know Pacnet lucked out and simply got a judge that interpreted the law in their favour or was simply more sympathetic to their case or that Starhub & Singnet need to change to a different law firm when they fight IP cases. Since I don’t know the details, I personally will not make any judgements about the ethics and conscience of any of the three companies. As far as I can tell, Odex had to go to court to try and get ALL three companies to release info on their subscribers and it was not a case of Pacnet really going above and beyond.

haiz all i know is that odex want us to buy their DVD/VCD which are really damn cheap now and at the same time catching us… but the hook with bait is really damn hard for us to bite

well, at least all hope is not lost.
Judges are also human, they have moral judgment and not absolutely bound by rules set on stone.
after a long journey, now that we finally see light at the end of the tunnel, hopefully it’s not the light from the oncoming train, spelling an end to customer privacy.

Yes, a way to fight back. If ODEX fails in their appeal, those who got the letter or heck, anyone who wants to be a non-NATO, can SUE Odex back.

Ya know, don’t be too happy yet. If you’ve read today’s Straits Times, you’d realize that
(a) the ruling is unprecedented;
(b) lawyers were _very_ surprised at Judge Lau’s decision;
(c) a “refused to be named” lawyer remarked that it would mean the plaintiff had to prove that it had a high chance of winning even before obtaining the IP, and NMP Siew Kum Hong said this could be extremely expensive for firms .
The above two lawyers could be quoted out of context, but it is clear as crystal that the ST’s slant on this issue is very strongly biased towards Odex. In any case, this gives me the impression that Judge Lau is being very very brave by going against conventional law wisdom and upholding internet subscribers’ privacy. The next judge may or may not be so avant-garde, so who knows how it could turn out.

On the other hand, TNP is much more balanced. Here’s Mr Siew Kum Hong’s quote on the ruling (verbatim):
“Very often, including in the media, there is insufficient recognition of people’s rights, or even the rights of the infringers. The judge put in a lot of effort and took pains to consider that.”
As I suspected, Mr Siew’s quote in Straits Times was indeed taken out of context. Of more importance (unmentioned prior to this) is the following note regarding BayTSP:
(a) there was no evidence from BayTSP against the said infringers;
(b) there was no evidence that Odex engaged BayTSP;
(c) only publicly available articles from BayTSP were presented (including FAQ).
Am I the only one who’s feeling extremely uncomfortable that subscribers’ details are being released so easily, and based on so little incriminating evidence (as in the Singnet / Starhub case)?

so happy that pacnet win although i a singnet user. after reading some article, then i reliease that singnet is so useless!!!it like hell!! thir lawer never go to the court for hearing andthey just release thier consumer information cos odex gave a court order wht the hack!!!! such a losser!!!!!!!!!!

that’s why, singnet and starhub had stated in the past how they do business with their customer in mind.
when it comes to actual case of customer’s privacy intrusion , they showed their true colours, they ran away like dogs.
it makes you think what kind of screwed up lawyers they picked, andhow privacy-unfriendly singapore law can be.

This is great. Assuming that Pacnet last for the next 14 days, Odex are going to have to face lawsuits against both people who they have sued, as well as singnet and starhub. And Odex is going to have though times ahead of them….

Apparently singnet didn’t even fight the case. They just requested Odex to produce a court order and when Odex did, they simply complied. I’ll assume no arguments made.

the ISP will only provide the identities of the IP when a court order is given, they did not mention they will protect or fight before a court order is ruled. Not to mention odex paid an ISP a sum of money so they will consent and not send a lawyer to represent them.
the other case were either represented by clueless lawyers or just for show.
